TERMS & CONDITIONS – NOCTE BEAUTY, LLC

Welcome to Nocte Beauty. These Terms & Conditions (“Terms”) govern your use of www.noctebeauty.com (the “Site”) and the purchase and use of products from NOCTE BEAUTY, LLC (“we”, “us”, “our”).

By accessing the Site and/or purchasing something from us, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Eligibility and Use of the Site

• You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase products from this Site.
• If you are under 18, you may use the Site only with the involvement of a parent or legal guardian.

• We try to present product descriptions, ingredients, and images as accurately as possible; however, we do not warrant that product descriptions or other content is always accurate, complete, reliable, current, or error-free.
• Colors may appear differently on screens than in real life. Packaging may change from time to time.

Prices and availability are subject to change without notice.
We reserve the right to:

• Modify or discontinue any product at any time
• Limit quantities purchased per person, per household, or per order
• Refuse or cancel orders if there are pricing errors or other issues

If we cancel an order after you have been charged, we will issue a refund to your original payment method.

4. Orders and Payment

• Authorize us and our payment processor to charge your chosen payment method for the total order amount (including applicable taxes and shipping)

We may refuse or cancel an order if we suspect fraud, unauthorized activity, or if the product is unavailable.

All prices are listed in U.S. dollars unless stated otherwise. Applicable taxes and shipping costs are added at checkout.

5. Shipping, Risk of Loss, and Delivery

Shipping is governed by our Shipping Policy, which forms part of these Terms. In summary:

• We currently ship only within the United States.
• Orders typically ship within 1–3 business days, but processing times may be longer during busy periods or holidays.
• Delivery timelines are estimates, not guarantees. Carrier delays are outside our control.
• Title and risk of loss pass to you when we deliver products to the carrier.

6. Returns and Refunds

Returns and refunds are governed by our Refund & Return Policy, which forms part of these Terms. Please review that policy before purchasing, especially since we sell personal care products with hygiene limitations.

You may use the Site and its content for personal, non-commercial use only. You may not:

• Use our trademarks, logos, or trade dress without our prior written consent

8. User Content (Reviews, Comments)

Patch Test: We recommend performing a patch test before first use (apply a small amount to a small area of skin and wait 24 hours).

14. Dispute Resolution and Arbitration

Most customer issues can be resolved quickly and to your satisfaction by emailing us at support@noctebeauty.com. If we cannot resolve a dispute informally, you and we agree to resolve it through binding arbitration on an individual basis, rather than in court, except as noted below.

This means:

• You and we waive the right to a jury trial.
• You and we waive the right to participate in a class action or class arbitration.

Arbitration will be conducted by a reputable arbitration provider under its consumer rules. Arbitration will take place in New Jersey or by remote means (such as video conference). The arbitrator may award the same types of relief a court could, but only in favor of the individual party seeking relief and only to the extent necessary to provide relief on that party’s individual claim.

Exceptions:
Either party may:

• Bring an individual action in small claims court, or
• Seek injunctive or other equitable relief in a court of competent jurisdiction to prevent infringement, misuse, or unauthorized disclosure of intellectual property or confidential information.

If the class action waiver is found unenforceable, this arbitration provision will be void.

15. Governing Law and Jurisdiction

These Terms and your use of the Site shall be governed by and construed in accordance with the laws of the State of New Jersey, USA, without regard to its conflict of law principles.

For any disputes that are not subject to arbitration, you agree to the exclusive jurisdiction of the state and federal courts located in New Jersey.

16. Termination

We may suspend or terminate your access to the Site at any time, without notice, if we believe you have violated these Terms or engaged in fraudulent or harmful activity.

You may stop using the Site at any time. Sections of these Terms that by their nature should survive termination (such as intellectual property, disclaimers, limitations of liability, and dispute resolution) will continue to apply.

We may update these Terms from time to time. When we do, we will update the “Last Updated” date at the top. Changes are effective when posted on the Site.
